Joint Council Update - Adoption Tax Credit FAQ


Given the complexities of the new Adoption Tax Credit, the Adoption Tax Credit Working Group, of which Joint Council is a member of the Executive Committee, a FAQ has been prepared.  The FAQ provides much needed information on the various aspects of the tax credit.  We hope you find it useful in providing an explanation of the tax credit to your adoptive prospective adoptive families.

The FAQ will be available on the Working Group’s website.  Our thanks go out to the entire executive committee but especially to NACAC and Voice for Adoption for their leadership and expertise on the FAQ.

President Obama Passes Legislation to Permanently Extend Adoption Tax Credit

Washington, DC—January 4, 2012—Late Tuesday night, January 1, Congress passed the American Taxpayer Relief Act of 2012 (H.R. 8), legislation that included a permanent extension of the adoption tax credit. President Obama signed the bill into law Wednesday.

Since it was established in 1997, the adoption tax credit has helped thousands of American families offset the high cost of adoption or meet their adopted children’s special needs. The credit was set to virtually disappear as of December 31, 2012. Earlier this year, the Adoption Tax Credit Working Group Executive Committee established four priorities for an adoption tax credit that is inclusive, permanent, refundable, and flat for special needs adoptions.

“By making the adoption tax credit permanent, Congress has renewed its commitment to finding a safe and loving homes for children in need,” said Kathleen Strottman, Executive Director of the Congressional Coalition on Adoption Institute (CCAI). CCAI serves as the Secretariat of the Adoption Tax Credit Working Group Executive Committee. “We are thrilled that three of the four priorities established by the Executive Committee were included in this legislation. Unfortunately, without making the adoption tax credit refundable, many adoptive families of foster children with special needs will not be able to benefit from the credit."

The bill permanently extends the adoption tax credit and income exclusion for employer paid or reimbursed adoption expenses. While official estimates will be released later by the IRS, the projected maximum amount of the adoption credit for 2013 is expected to be $12,770.

The benefits of the adoption tax credit reach beyond the children who are adopted. A 2006 study cited by the Children’s Bureau found that taxpayers save as much as $126,000 for every child who is adopted instead of remaining in long-term foster care. Significant savings to society are also achieved because children who are adopted fare better than those who live out their childhood in foster care. With more than 100,000 children in U.S. foster care waiting to be adopted, and countless millions of children worldwide without families, the continuation of the adoption tax credit helps provide love, safety, and permanency to many of these children.


The Adoption Tax Credit Working Group is a national collaboration of organizations and individuals uniting to support the cause of adoption by advocating for the adoption tax credit. We believe the adoption tax credit is an important resource to help children find forever families and make adoption affordable for all.

Joint Council Update - Adoption Tax Credit Passes

Late last night the US House of Representatives passed the American Taxpayer Relief Act (full text) which includes a permanent extension of the adoption tax credit. As a more complete understanding of the law’s impact becomes available during this week, we will publish the details and specifics on how this impacts children, families and our Partner organizations.

This victory for children and families once again shows the need, value and strength of working as a united coalition. Our thanks go out to the more than 50 Joint Council Partners who engaged with us on the tax credit and helped make it happen.

Joint Council also thanks those members of Congress who championed the adoption tax credit and ensured that children and families will continue to benefit from this very important assistance. As a founding member of the Adoption Tax Credit Working Group Executive Committee (see full list below), we also thank the more than 130 organizations involved in the Adoption Tax Credit Working Group for their diligent and important work with Congress and the Obama administration.

Important Adoption Tax Credit Updates!!

Dear Adoption Tax Credit Working Group Members:

We are pleased to provide you with the following update on the status of the federal Adoption Tax Credit (ATC) and pending legislative efforts related to it. Our progress thus far is very much because of the continued advocacy of the members of this Working Group and we want to encourage you to continue to engage your networks in reaching out to their Representative and Senators to express support for the extension of the adoption tax credit and the inclusion of refundability of the credit.

Update on the Senate Adoption Tax Credit Bill
S. 3616 A bill to amend the Internal Revenue Code of 1986 to make permanent the expansion of tax benefits for adoption enacted in 2001 and to permanently reinstate the expansion of tax benefits for adoption enacted in 2010, and for other purposes, the Senate ATC bill including refundability (the companion to House bill H.R. 4373) was introduced Friday, September 21, 2012 by Senators Landrieu (D-LA), Blunt (R-MO), Hutchison (R-TX) and Cardin (D-MD)!  Please begin to reach out to Senators and encourage their support for it and please be sure to take time to thank the above four original Co-Sponsoring Senators for their tremendous leadership as well.

Update on H.R. 4373: Making Adoption Affordable Act of 2012
There are now 29 co-sponsors of this bill! While this is a good start, we would like to see even more Members support this legislation.  Please continue to contact U.S. Representatives about H.R. 4373 – especially if they are a Republican Member of Congress or sit on the House Ways & Means Committee (http://waysandmeans.house.gov/About/Members.htm).  This bill and this issue are bipartisan – but recently H.R. 4373 gained several Democrats as new cosponsors, so we need to work together to keep this bill evenly supported.

General Update
The Adoption Tax Credit is likely to be included in a package of other tax credits that need to be extended, and we expect such a package to be considered by Congress sometime after the election. The Middle Class Tax Cut Act, which passed in early August, included an extension through 2013 of the ATC without refundability, and the House passed H.R. 8 with a straight extension of the ATC without refundability. These bills may or may not reflect what could be passed at the end of the year.  Since neither of these bills included a refundable credit, we are concerned the final extended credit will also not be refundable.  We are working hard to get refundability back on the table and need your help in showing Members that refundability helps foster care adoption and lower to middle income tax filers.

We face three hurdles when it comes to refundability. First, it adds to the cost in a time when Members are looking to scale back most proposals. Second, certain Members have expressed concerns that refundable credits in general have an increased likelihood of fraud and abuse, and finally, refundability was added to the ATC as part of the Patient Protection and Affordable Care Act (which is in the center of political debate right now.) We can respond to these concerns in several ways—by noting there has been no evidence of fraud related to the ATC, by explaining that finding children a family saves money over caring for them in foster care, and by reminding Members that the ATC and adoption have always been bipartisan issues. One of the most effective ways to respond to these concerns is by continuing to highlight examples through sharing the personal stories of individual families and/or encouraging families to share their stories directly with their legislators.

Please continue to reach out to and communicate with Members and staffers on Capitol Hill about the refundable ATC so that Members feel pressure to keep the ATC part of any deal that moves in the lame duck session after elections.  Our goal remains to have both the above pieces of legislation supported by the majority of Members in the House and Senate, especially Members of the Senate Finance and House Ways and Means Committee.

Save The Adoption Tax Credit: An Update & Appeal

Dear Colleagues and Friends,

Save The Adoption Tax Credit is one of the most urgent and important initiatives Joint Council will make in 2012.   We are actively participating in a number of initiatives designed to engage the US government in crafting policies favorable to families, children and intercountry adoption - the tax credit is at the top of the list.  Simply put – without reinstating the tax credit, many families finalizing in 2012 and all families finalizing in 2013 will lose over $13,000 in tax credits.  Obviously this will seriously impact the number of families willing and able to adopt children domestically, internationally or through the US Foster Care system. 

Joint Council would like to thank its Partner organizations (listed below) who have signed on as members of the Adoption Tax Credit Working Group.  While we are thrilled to have 46 of our Partners joining us, our goal is for 100% participation from our Partner base.  If your organization has not yet joined the Adoption Tax Credit Working Group or you believe your organization has but is not listed above, please contact  Shari Cohey at the Congressional Coalition on Adoption Institute (shari@ccainstitute.org) and become a member of the Adoption Tax Credit Working Group today.  The only way the Tax Credit will be reinstated is if we join together as a community.

Save the Adoption Tax Credit

As we announced last Thursday, the Adoption Tax Credit Working Group, of which Joint Council is a member of the Executive Committee, launched Save The Adoption Tax Credit.   Simply put – without reinstating the tax credit, many families finalizing in 2012 and all families finalizing in 2013 will lose over $13,000 in tax credits.

Obviously this will seriously impact the number of children finding a permanent family  through adoption. 
If you have not yet done so, I urge you to;

  2. Use email, websites, blogs and twitter to urge your clients and supporters to join Save The Adoption Tax credit by ‘liking’ our Facebook page
  3. Contact  Shari Cohey at the Congressional Coalition on Adoption Institute (shari@ccainstitute) and sign-up your organization as a member of the Adoption Tax Credit Working Group
